1. WHO WE ARE
Mindset Mastery Mentorship LLC ("Mindset Mastery Mentorship," "we," "us," or "our") operates the coaching programs, events, retreats, digital products, and content offered by Coach Logan Duong, along with our websites, landing pages, and communication channels (together, the "Services"). This policy explains what information we collect, how we use it, who we share it with, and the choices you have. By using our Services or giving us your information, you agree to the practices described here. If you have signed a separate agreement with us, such as a coaching agreement or nondisclosure agreement, that agreement may contain additional terms that also apply.
2. INFORMATION WE COLLECT
Information you give us We collect information you choose to provide when you opt in to a free resource, register for a webinar or masterclass, fill out an application, book a consultation call, purchase a program, attend an event, join a community, or contact us. This may include: • Contact details such as your name, email address, phone number, and social media handles. • Billing details such as your billing address. Card numbers are handled by our payment processors, not stored by us. • Demographic details such as your age, city, and zip code. • Application and intake answers about your goals, background, relationship and dating experience, career, and what you want from coaching. • Messages, posts, and files you send us through email, text, direct message, Telegram, or our community spaces. Some of what you share during an application or coaching relationship may be personal in nature. Please share only what you are comfortable sharing. You can decline to answer any question, although that may limit our ability to serve you. Information collected automatically When you visit our websites or open our emails, we and our service providers automatically collect certain technical information, including your IP address, browser type, device and operating system, pages viewed, links clicked, referring website, approximate location based on IP address, and the date and time of your visit. We collect this through cookies, pixels, and similar technologies described in Section 7. Information from third parties We may receive information about you from advertising platforms, social media networks, scheduling tools, and payment processors, for example when you click one of our ads, submit a lead form on Instagram or Facebook, or interact with our content on YouTube or another platform.
3. HOW WE USE YOUR INFORMATION
We use your information: • To deliver the programs, calls, events, retreats, and products you sign up for or purchase. • To review applications and determine fit for our coaching programs. • To schedule and confirm calls and send reminders. • To process payments, prevent fraud, and manage refunds and disputes. • To respond to your questions and provide client support. • To send you content, event invitations, and offers you have agreed to receive. • To show you relevant ads and measure how our advertising performs. • To understand how people use our Services and improve them. • To comply with the law, enforce our terms, and protect the rights and safety of our clients, our team, and the public. Most of your customer information is stored in a third-party Customer Relationship Manager (CRM) system called Close.io, and not directly on our servers. We do not sell your personal information.
4. MESSAGES AND CONTENT YOU SEND US
By posting messages in any group, community, or channel owned by Mindset Mastery Mentorship LLC, or by sending us emails or messages, you automatically grant Mindset Mastery Mentorship LLC a royalty-free, perpetual, irrevocable, nonexclusive, worldwide right and license to use, reproduce, modify, adapt, publish, translate, sublicense, copy, and distribute those messages in any media. This means that anything you send in a group owned by Mindset Mastery Mentorship LLC, and any message or email you send us, can be used by Mindset Mastery Mentorship LLC for any purpose, without warning or notification to you. We also have a Film Release. Please see our Terms and Conditions for more information on our Film Release.
5. EMAIL COMMUNICATIONS
If you opt in, we will send you emails about our content, programs, events, updates, and offers. We send marketing emails only to people who have given us permission, either directly or through a platform where they opted in to hear from us. You can unsubscribe at any time using the link at the bottom of any marketing email or by emailing us at [SUPPORT EMAIL]. Even after you unsubscribe from marketing, we may still send transactional messages related to your purchases, account, or scheduled calls. By giving us your email address, you also allow us to use it in hashed form to create custom and lookalike audiences on advertising platforms such as Meta (Facebook and Instagram), Google, and YouTube, so that we can show our ads to people who have opted in to hear from us, and to people similar to them.
6. PHONE CALLS, SMS TEXT MESSAGING, AND MOBILE INFORMATION
Telemarketing By submitting your telephone contact information on our site and/or registering to receive the products and/or services offered by Mindset Mastery Mentorship LLC, you agree that such act constitutes a purchase, an inquiry, and/or an application for the purposes of the Amended Telemarketing Sales Rule (ATSR), 16 CFR 310 et seq., and any applicable state and local "do not call" regulations. We retain the right to contact you via telemarketing in accordance with the ATSR and applicable state regulations. SMS text messaging If you separately opt in to receive text messages from Mindset Mastery Mentorship LLC, you consent to receive recurring automated marketing and informational text messages at the number you provided, including call reminders, event invitations, educational content, promotions, and offers. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP. For help, reply HELP or email [SUPPORT EMAIL]. Mobile information, SMS opt-in data, text messaging originator opt-in data and consent, and phone numbers collected for SMS purposes will not be sold, shared, rented, leased, traded, transferred, disclosed, or otherwise provided to third parties or affiliates for their marketing or promotional purposes. We share this information only with the service providers, carriers, and vendors that help us deliver the messages you requested, and only for that purpose, or when required by law. All of the categories above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
7. COOKIES, ANALYTICS, AND ADVERTISING
Cookies are small files stored in your browser. Pixels and tags are small pieces of code that tell us when a page is viewed or an action is taken. We use these technologies for the following purposes: Essential: Keeps pages, forms, checkouts, and member areas working and secure. Functional: Remembers your choices and saves you from re-entering information. Analytics: Shows us how visitors find and use our pages so we can improve them. We use tools such as Google Analytics. Advertising: Lets platforms such as Meta, Google, YouTube, and TikTok show you our ads on other sites and apps and measure whether those ads led to a sign-up or purchase. Social: Lets social networks record when you share or engage with our content through their buttons or embeds. Your choices You can block or delete cookies in your browser settings, although parts of our Services may not work correctly without them. You can also: • Opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout • Adjust your Meta ad preferences at https://accountscenter.facebook.com/ad_preferences • Adjust your Google ad preferences at https://myadcenter.google.com • Opt out of interest-based ads from participating companies at https://optout.networkadvertising.org and https://optout.aboutads.info • Hide any individual ad from us using the menu on that ad within the platform. Do Not Track and Global Privacy Control There is no common standard for browser "Do Not Track" signals, so we do not respond to them. Where required by law, we treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sharing of your information for targeted advertising for that browser.
8. HOW WE SHARE INFORMATION
We share personal information only as described below. • Service providers who work on our behalf, including our CRM, email, and SMS platforms, payment processors, scheduling tools, video conferencing, community and messaging platforms, website hosting, analytics providers, and contractors on our team. They may use your information only to provide services to us and must keep it confidential. • Advertising and analytics partners, as described in Section 7. • Event and retreat partners, such as venues, lodging, and transportation providers, when needed to deliver an event you registered for. • Legal and safety purposes, when we believe in good faith that disclosure is required by law or legal process, or is necessary to protect the rights, property, or safety of Mindset Mastery Mentorship LLC, our clients, or the public. • Business transfers, if we are involved in a merger, acquisition, financing, or sale of assets, in which case your information may transfer to the new owner subject to this policy. • With your consent, for any other purpose you approve.
9. PAYMENTS
Your credit card information is not stored by us, and is instead passed to our payment processors. These include but are not limited to: Stripe, PayPal, Coinbase, Zelle, and PayThen. These processors handle your payment information under their own privacy policies and security standards. By making a purchase, you authorize us to share the information needed to complete the transaction with them.
10. INTERNATIONAL TRANSFERS
We are based in the United States, and your information may be stored and processed in the United States and in other countries where we, our team members, or our service providers operate, including countries where we host retreats and events. Privacy laws in those countries may differ from those where you live. By using our Services, you understand that your information may be transferred to these locations.
11. DATA RETENTION
We keep personal information only as long as reasonably necessary for the purposes described in this policy, including delivering your program, maintaining business and tax records, resolving disputes, and meeting legal obligations. When information is no longer needed, we delete it or de-identify it so it can no longer be linked to you.
12. SECURITY
We use reasonable administrative, technical, and physical safeguards to protect your information, including encrypted (SSL/TLS) connections on our websites and checkouts, and confidentiality obligations for team members and vendors who access your data. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please avoid sending sensitive information, such as card numbers or government ID numbers, through email, text, or chat.
13. AGE REQUIREMENT
Our Services are intended only for adults 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from someone under 18, we will delete it. If you believe a minor has provided us with information, please contact us.
14. YOUR PRIVACY RIGHTS
Depending on where you live, you may have some or all of the following rights. We extend these options to all of our users where reasonably possible. • Access: ask what personal information we hold about you and request a copy. • Correction: ask us to correct inaccurate information. • Deletion: ask us to delete your personal information. • Portability: ask for your information in a commonly used format. • Opt out: stop marketing emails and texts, and opt out of the sharing of your information for targeted advertising. • Withdraw consent: withdraw consent you previously gave, without affecting processing that already happened. To protect your privacy, we will verify your identity, usually by matching the request to the email address or phone number we have on file. You may use an authorized agent where the law allows, and we may ask for proof of that authorization. We will respond within the time required by applicable law. We may keep certain information when required or permitted by law, for example transaction records. Once your data is deleted, we cannot restore it, and you may lose access to past purchases and program materials connected to your account. We will not discriminate against you for exercising your privacy rights. If we deny your request, you may appeal by replying to our decision, and we will review it.
15. CALIFORNIA RESIDENTS
If you live in California, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, may give you the rights listed in Section 14, along with the right to limit the use of sensitive personal information and the right to know the categories of information we collect and share. In the past 12 months, we have collected the following categories of personal information: identifiers (such as name, email, phone, and IP address); customer records (such as billing address); characteristics you choose to share (such as age); commercial information (such as purchases); internet activity (such as browsing and ad interactions); approximate geolocation; audio and visual information (such as call and event recordings); and professional or personal details you share in applications and coaching. We collect this information from the sources and for the purposes described in Sections 2 and 3, and we disclose it to the categories of recipients in Section 8. We do not sell personal information for money. Our use of advertising cookies and custom audiences may be considered "sharing" for cross-context behavioral advertising under California law. You can opt out by emailing [email protected] with the subject line "Do Not Share My Information," by using a Global Privacy Control signal, or by using the choices in Section 7. We do not knowingly sell or share the personal information of anyone under 16. Under California's "Shine the Light" law, California residents may request information about any disclosure of personal information to third parties for their own direct marketing purposes. 16. RESIDENTS OF OTHER U.S. STATES
Residents of states with comprehensive privacy laws, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and others, may have rights similar to those in Section 14, including the right to appeal a denied request. If your appeal is denied, you may contact your state Attorney General. Nevada residents may submit a request directing us not to sell covered information by emailing [SUPPORT EMAIL]. We do not currently sell covered information as defined under Nevada law.
17. EU AND UK VISITORS
If you are in the European Economic Area or the United Kingdom, we process your personal information based on your consent, to perform a contract with you, to comply with legal obligations, or for our legitimate interests in running and growing our business, where those interests are not outweighed by your rights. You have the rights listed in Section 14, plus the right to restrict or object to processing and the right to lodge a complaint with your local data protection authority.
18. THIRD-PARTY LINKS AND PLATFORMS
Our Services link to and run on third-party websites and platforms, including social media, video, payment, and messaging services. This policy does not cover those third parties, and we are not responsible for their practices. Please review their privacy policies.
19. CHANGES TO THIS POLICY We may update this policy from time to time. When we do, we will revise the "Last updated" date above.
